Terms of Service

Introduction

These Terms of Service ("Terms") govern your use of the Banana2.1 website and services (the "Services"), operated by Banana2.1 ("we", "us" or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

Banana2.1 is an independent service and is not affiliated with or endorsed by Google. Nano Banana and Gemini are trademarks of Google LLC.

Accounts and Eligibility

You must be at least 18 years old, or the age of majority where you live, to use the Services, or use them with the permission of a parent or legal guardian. Generating images requires an account.

When you create an account, you must provide accurate and complete information. You are responsible for safeguarding your password and for all activity under your account. Creating multiple accounts to collect additional free credits is not allowed.

Use of Services

The Services let you generate and edit images in your browser with Nano Banana 2.1, Google's image generation and editing model. Features, output resolutions and model availability may change over time, including when Google updates or retires the underlying model.

Credits, Subscriptions and Refunds

Image generation is paid for with credits:

• Credit cost: each image costs 2 credits at 1K, 4 credits at 2K and 8 credits at 4K resolution. If a generation fails, the credits used for it are returned to your balance.
• Free credits: every account with a verified email address receives 10 free credits each month (5 images at 1K). Free credits expire at the end of the month and do not roll over.
• Subscriptions: paid plans renew automatically every month or year until cancelled. You can cancel at any time; cancellation takes effect at the end of the current billing period, and your plan stays active until then.
• Credit packs: credits bought as a one-time pack never expire.
• Refunds: except where required by applicable law, payments are non-refundable and credits have no cash value. If you believe you were charged in error, email support@banana2-1.com and we will review your request.

Current prices and plan details are listed on our Pricing page. Price changes never affect a billing period you have already paid for. Payments are handled by our third-party payment processor.

Acceptable Use

You agree not to use the Services to:

• Create or share content that is illegal or that infringes anyone's intellectual property, privacy or publicity rights
• Create sexual content involving minors, non-consensual intimate imagery, or content that harasses, threatens or defames others
• Impersonate real people or create deceptive content intended to mislead, defraud or spread disinformation
• Generate content that violates the usage policies Google applies to its generative AI models
• Attempt to gain unauthorized access to our systems, interfere with the Services, or abuse free credits through automation or multiple accounts
• Distribute malware or other harmful code

Your Content and Generated Images

You keep any rights you have in the prompts and images you submit ("Inputs"). You grant us a worldwide, non-exclusive, royalty-free license to host, process and transmit your Inputs and the images generated for you ("Outputs") only as needed to operate the Services.

Subject to these Terms and applicable law, you may use your Outputs for personal and commercial purposes. You are solely responsible for your Inputs and Outputs and how you use them. AI output can be inaccurate or resemble content generated for others, and images created with Nano Banana 2.1 may carry an invisible SynthID watermark added by Google.

Intellectual Property

The Banana2.1 website, software, design and original content (excluding your Inputs and Outputs) are owned by us or our licensors and are protected by copyright, trademark and other intellectual property laws. Nano Banana, Gemini and Google are trademarks of Google LLC; other names may be trademarks of their respective owners.

Third-Party Services

The Services rely on third parties, including our AI model provider, which runs Google's Nano Banana 2.1 model to generate and edit images from your Inputs; Cloudflare, which hosts the Services, stores images and checks sign-ups for bots; our payment processor, which handles payments; and analytics providers. Their own terms and policies may apply, and we are not responsible for their services. See our Privacy Policy for details.

Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Services will be uninterrupted, secure or error-free, or that Outputs will be accurate, unique or fit for a particular purpose.

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or goodwill, resulting from your use of or inability to use the Services. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

Termination

You may stop using the Services at any time and may ask us to delete your account by emailing support@banana2-1.com. We may suspend or terminate your account if you violate these Terms or if required by law. Credits in an account terminated for violating these Terms are forfeited.

Governing Law

These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to its conflict-of-law rules. Mandatory consumer protection laws of your country of residence still apply.

Changes to Terms

We may update these Terms from time to time. We will post the updated Terms on this page and change the "Last updated" date, and for material changes we will make reasonable efforts to notify you. Continuing to use the Services after changes take effect means you accept them.
